The Chinese government has issued new polices on change of statutory retirement age of employees and relevant implementing rules. China will take 15 years to progressively raise the statutory retirement ages of employees, for male employees from 60 to 63 and for female employees from 50 to 55 or from 55 to 58 depending on their job positions. Under the new retirement system, employees will reach statutory retirement ages at different times due to their different dates of birth. Further, some employees will have flexibility to decide their retirement age, which can be earlier or further delayed.
The changes will impact employers’ daily HR management and bring challenges to employers.

Jeanette Yu is Partner and head of Employment & Pensions of CMS, China. She has more than 20 years’ experience in providing legal advice for international companies on Chinese labour law issues and compliance management in China. Her extensive track record comprises international secondment, data privacy, non-competition, social security, trade union and labour disputes. She has also been involved in significant projects of business transactions and restructuring advising clients on employee transfer, relocation and lay-off of employees as well as negotiation of employment contracts and separation agreements. Since 2017, Jeanette has been acting as the National Chair/Vice Chair of HR Working Group of European Chamber of Commerce in China.
Chase Chen is Associate at CMS Shanghai Office. He focuses on the employment practice area and has been advising clients on employment issues, including labour contract, hiring and terminating employees, non-competition and trade secret, work permit, secondment and visa issues of expatriates as well as providing advice on labour disputes and employment related due diligences since 2017. He has also advised clients on compliance issues such as compliance policies and misconduct investigation, etc
